$350,000 – Carol – Albertville, Minnesota

An office manager for the New Hope Police Department was on her way to work one morning when she was rear-ended by a motorist who lost control of his vehicle. She suffered what her doctors initially thought was a mild strain of her neck. However, when the pain did not go away, she underwent an MRI scan which revealed significant and serious damage to her vertebrae and discs, which was pinching her nerves and sending pain signals down her arms. Her doctors elected to perform radiofrequency neurotomy, which was a tremendous success for her, reducing the pain.

The catch was that relief from radiofrequency neurotomy is of limited duration, requiring the patient to repeat the procedure every 12 to 16 months; and the procedure is not inexpensive.  To make matters worse, her doctors imposed permanent restrictions which precluded her from returning to the job she loved.

Our attorneys attempted to negotiate a settlement with the insurance carrier that will cover not only future medical coverage for the neurotomy procedures, but also money to cover her lost wages to her age of retirement. When the insurer would not negotiate, our attorneys filed a lawsuit. After several months of litigation, our attorneys were able to secure a settlement, from which the client could set aside money to cover future neurotomies, as well as sufficient cash to cover her lost wages.

$100,000 – Tonya – Brooklyn Center, Minnesota

A former client was involved in a significant motor vehicle crash while riding as a passenger, when another vehicle entered an intersection on a red light and T-boned the car. The impact occurred at the passenger side door, right where our client sat. She knew who to call right away.

MRI scans revealed no disc abnormalities, and it was assumed she sustained an “invisible” soft tissue injury to her neck. She underwent chiropractic care, physical therapy, and eventually injections. Her doctors told her the injury was permanent and to some degree or another, she would experience pain in and around the neck.

Our attorneys engaged in negotiations with the insurer. We obtained medical reports addressing the neck injury, and though it could not be seen on MRI scan, demonstrated that it was a viable injury requiring treatment. After numerous rounds of negotiations, the insurer finally agreed to pay the policy limits.

$125,000 – Joan – Chanhassen, Minnesota

An 85-year-old female was injured as she entered a large department store, located at a mall. Surveillance footage of the incident showed her walking into the entryway at a normal speed, and the doors suddenly shut on her. The impact of the closing door pushed her to the ground, and she can be seen struggling to stand up.

She was taken by ambulance to a local hospital, where it was revealed that she had a fractured pelvis.  In the ensuing months, she underwent several courses of physical therapy but, unfortunately, to this day, she continues to experience pain in and around her pelvic region.

Our attorneys presented a claim to the department store.  The department store accused our client of contributing to her own injury and refused to make any offer, despite the surveillance footage. A lawsuit revealed that the sensor at the door was faulty and had been faulty for several months. After brief litigation, our attorneys were able to secure a settlement.
