Chronic Lymphedema from Prostate Cancer Surgery, Swelling, Neuropathy, and Discomfort in Groin and Lower Extremities, Lumbar Disc Herniation, Cervical DDD
A Dragline Operator suffered from chronic lymphedema following prostate cancer treatments, which caused chronic pain in his lower extremities and back. He worked in coal mines when he applied for and received Long Term Disability benefits. After two years, his insurer stated he was capable of working in a sedentary position, despite his physician’s restrictions, and denied benefits. He was at a loss and reached out to the Fields Law team for help.
Our attorneys submitted an appeal for him, but the insurer looked for every loophole to deny his claim. We stuck with our client and filed a lawsuit on his behalf. A former Production Technician worked at a major mining facility until she suffered injuries to her neck and back. She was initially approved for benefits by her insurer. Unfortunately, after one year, her the insurer unexpectedly terminated her benefits. She reached out to the professionals at Fields Law Firm for assistance.
Our attorneys crafted a strong appeal by providing the insurer objective medical evidence, including MRI and X-ray results, of our client’s ongoing issues and treatment for her conditions. Her insurer upheld their denial of benefits because they believed the conditions our client was suffering from did not rise to the severity they believed necessary to prevent her from working.
In response, we filed a lawsuit against the insurer in pursuit of the client’s benefits. Due to the standard of review, it was determined that a settlement was in the client’s best interest. Travis – Service Maintenance Mechanic – Rock Springs, Wyoming
Crush Injury to Left Foot, Left Leg Resulting in CRPS/RSD
A maintenance mechanic suffered a crush injury to his left foot and leg while working. He received benefits from his employer’s Workers’ Compensation insurer, but he was also eligible for Long Term Disability benefits. His insurer paid him benefits for approximately two and a half years.
During the time he was receiving benefits, he was diagnosed with CRPS/RSD of the left ankle. Instead of recognizing the seriousness and the progressive nature of the ankle injury, Aetna discontinued his benefits out of the blue, indicating he should be able to return to work as a Pump Service Supervisor or a Pager, two jobs that he had never previously performed.
He turned to Fields Law Firm for help appealing the denial decision. Our team went through the insurer’s file, citing errors in the report of the Independent Medical Examiner, the examiner whose report Aetna relied on in discontinuing our client’s benefits. Our attorneys crafted a strong appeal. A few weeks after submitting the appeal, Aetna reversed their prior denial of benefits and paid our client his backpay and his monthly benefits.
