Joseph – Customer Service Manager – Savannah, Tennessee

Memory Loss, Dizziness, Chest Pain, Slurred Speech

A Customer Service Manager from Tennessee began having cognitive issues. He had trouble remembering things, would lose his balance, and his speech began to slur. He was no longer able to work in his managerial role. He received Long Term Disability benefits from his insurer at work for about six months, but then The Standard stopped paying because they said he could return to work.

He was worried about his lost income and still unable to return to work, so he called Fields Law for help. Our team obtained the claim file from The Standard and our attorneys found that they were egregiously misinterpreting our client’s job responsibilities. We drafted a strong appeal to The Standard, pointing out the errors in how they handled our client’s claim. They changed their mind and our client received a lump-sum for back-pay and ongoing monthly benefits. Ehlers-Danlos Syndrome

A young woman from Tennessee suffered from numerous health problems, most notably Ehlers-Danlos syndrome. While she had been able to overcome many of the difficulties of her condition and had become very successful, eventually the disease took too much of a toll on her and she was no longer able to work. After resigning herself to the fact that she would never be able to work again, she submitted a claim for Long Term Disability benefits, but her insurance company denied the claim.

Afraid and not knowing what she was supposed to do, she found the attorneys at Fields Law Firm. Our attorneys reviewed all of the records Liberty Mutual had and began getting updated records to provide. Due to health care costs, our client was forced to move to Mexico. As a result of the move, many of her recent medical records were in Spanish. The Fields Law team went so far as to translate many of the records to submit to her insurer. We then drafted a winning appeal which highlighted the numerous faults in Liberty Mutual’s review of the claim. On appeal, Liberty Mutual reversed their decision and reinstated the payment of monthly benefits as well as the benefits which were already past due. Our client felt an incredible sense of relief knowing that she now had a source of income to support herself and her family.

Although her case required two separate appeals, our team was able to convince New York Life to reverse its denial, pay our client her back pay, and start paying monthly benefits. We secured narrative reports from her treating providers, all of the medical evidence related to her claim, and her entire Social Security Disability file, all establishing she could no longer perform her Own Occupation.
