Here are just a few examples of our Long Term Disability appeal case wins against Sun Life Financial.
Charlene – Office Administrator – Peabody, MassachusettsCharlene – Office Administrator – Peabody, MassachusettsCharlene – Office Administrator – Peabody, Massachusetts
Diabetes, Neuropathy, Exertional Dyspnea, Atrial Fibrillation, Chronic Artery Disease
An Office Administrator from Massachusetts suffered from a number of conditions which included morbid obesity, diabetes mellitus with neuropathy, exertional dyspnea, atrial fibrillation, chronic artery disease, history of diastolic heart failure, osteomyelitis, among other things. Her Long Term Disability insurer initially approved the claim but later denied it stating that she had the capacity to perform her own occupation.
Scared and not sure about what to do, she reached out to the attorneys at Fields Law Firm. Our attorneys reviewed all of the records from Sun Life Financial and ordered updated medical records. With updated records, our attorneys drafted a strong appeal which cited the medical evidence as to why she could no longer work. Upon review, Sun Life Financial overturned their denial and paid benefits. Our client was relieved knowing that she had an income on which to support herself and her family.
Doug – Tile Setter – Shawnee, Kansas
Bilateral Shoulder Pain, Complications from Rotator Cuff Surgeries
A tile setter from Kansas underwent rotator cuff surgery in both shoulders and experienced severe complications. He had constant pain and struggled to lift his arms above his shoulders. He applied for and was approved Long Term Disability benefits through his employer’s insurance plan. But after only two years, Sun Life Financial stopped paying him because they said he could return to work.
Upset at the insurer and worried about his lost income, he called Fields Law for help. Our team obtained the claim file from Sun Life Financial and found that they had overlooked key records about our client’s surgical complications. The Fields Law attorneys drafted a strong appeal to Sun Life Financial based on the factual and legal errors and updated expert opinions. Sun Life Financial changed their mind and our client received a lump-sum payment for back-pay and ongoing monthly benefits.
Ernest – Salesman – Chicago, Illinois
Chronic Regional Pain Syndrome, Massive Full Thickness Bilateral Rotator Cuff Tears
In Illinois a salesman suffered massive, full thickness rotator cuff tears to both shoulders, and subsequently developed chronic regional pain syndrome. He attempted to return to work but this proved unsuccessful and his doctors recommended additional surgeries.
He applied for Long Term Disability benefits through his employer’s insurance. The insurer reviewed the claim and eventually denied it. They could not conclusively determine if he remained covered under the policy after his failed attempt to return to work. Also, they were not convinced his conditions precluded him from performing his Own Occupation. Soon after the claim was denied, the salesman went back into the hospital for yet another surgery.
Fortunately, he found Fields Law and reached out for help fighting this decision. His attorney built an appeal that conclusively established our client indeed remained covered under the policy. Furthermore, due to his substantial condition, it was impossible for him to perform not only his Own Occupation but also any other gainful occupation. After reviewing our appeal, the insurer finally reversed its denial, paid our client his back pay and commenced monthly payments.
