Christian – Global Sales Representative – Aurora, Illinois

Cognitive Impairment, TBI

A 51-year-old gentleman, who worked as a Global Salesperson for a large business, suffered a traumatic brain injury. His job required him to reason, analyze and articulate highly complex sales concepts to potential buyers, which despite his earnest effort, he could no longer do.

He attempted to work for several months, but when he began to slur his words and forget his most important sales pitches, he saw his doctor. Neurocognitive tests were done and demonstrated that he suffered from in irriversible cognitive impairment condition. He applied for disability benefits which, despite the clear findings of cognitive decline, Prudential denied.

He then hired Fields Law Firm and its staff quickly moved to obtain all records as well as supportive reports from the treating doctors. An appeal was filed, and the denial was reversed in light of the substantial evidence that had been presented.

Inderpreet – Software Engineer – Roswell, Georgia

Traumatic Brain Injury, Sleep Difficulties, Depression

A software engineer from Roswell, Georgia suffered a concussion. As a result, she dealt with extreme difficulty sleeping, cognitive decline, headaches, and depression. Work became impossible because she could not concentrate. She applied for and received Long Term Disability benefits for a few months, but Prudential cut off her payments because they said she could return to work.

She was worried about her lost income and frustrated with Prudential, so she called Fields Law Firm for help. Our support team obtained the entire claim file from the insurance company and scoured it for errors in the record. The Fields Law attorneys built strong evidence and filed an appeal to Prudential, but they did not change their decision. The policy allowed for one final appeal and our attorneys gathered even more expert evidence to support our client’s claim. The final appeal was successful and our client received a lump-sum payment for backpay and ongoing monthly benefits. Atrial Fibrillation

A 61-year-old man working as a Sales Manager was forced to cease work due to complications with coronary heart disease and atrial fibrillation. Even though he had been paying premiums for Short Term and Long Term Disability benefits, when he applied for Short Term Disability benefits, his insurer claimed that he never actually obtained coverage. This was because there was one form he failed to fill out at the time he applied for the insurance. The Sales Manager was confused because he followed all the instructions he got from his employer when he applied for the insurance coverage. In his time of uncertainty, he turned to Fields Law for help.

The attorneys at Fields Law wrote a strong appeal on behalf of our client, arguing that his insurer was precluded from claiming he never had coverage when they took premiums from his checks. The Fields Law team also reached out to our client’s employer for information about how the employees applied for coverage. Through those conversations, we learned that many of employees from that particular company were also paying premiums for coverage they didn’t have. Based on our successful appeal, the insurer remedied the coverage issue and our client was issued back pay.
