Short & Long Term Disability Cases We’ve Won for Our Clients in Pennsylvania
Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability appeal and lawsuit case wins in Pennsylvania.
Betsy – Bank Teller – Pittston, Pennsylvania
CRPS
A bank teller from Pennsylvania suffered from Chronic Regional Pain Syndrome. This left her incapacitated by her pain and the side effects from the heavy narcotics used to manage her pain. Liberty Mutual, her Long Term Disability insurer, denied her claim stating that a reviewing doctor concluded that she had the ability to perform the duties of her job.
Clearly unable to work and not sure of how to fight the insurance company, she reached out to Fields Law. Our team of attorneys reviewed the entire file from Liberty Mutual and the report from their doctor. After completing this review, we developed a winning strategy for her appeal. We updated medical records and obtained statements from multiple doctors our client had treated with. With the updated records and reports, we then drafted an appeal which highlighted her condition and how it prevented her from working. Liberty Mutual reversed their decision and reinstated our client’s monthly benefits. Our client was so thankful to get her benefits back.
Rebecca – Shift Supervisor – Johnstown, Pennsylvania
Chronic Migraines
A shift supervisor at a retail store became disabled when her chronic migraines worsened and rendered her almost completely incapacitated. Her insurance carrier paid her claim for just over three months before denying benefits. Liberty Mutual abruptly sent the woman a denial letter stating there was insufficient medical evidence to show she was disabled. She was surprised because she had continued treating with her doctors who all agreed she could not work.
She decided to hired Fields Law to appeal the decision. Our attorneys updated her medical records and requested letters from her doctors describing our client’s severe migraines. Those documents were submitted with factual and legal arguments about Liberty Mutual’s failure to give appropriate weight to the medical records. Liberty Mutual reinstated benefits and paid our client everything she was owed under the terms of the policy. Our client was so pleased with the work done on the appeal that she hired Fields Law to continue monitoring her claim and ensure Libert Mutual treated her fairly.
Robert – Mechanic – Hollidaysburg, Pennsylvania
Back Pain, Sciatica
A man from Pennsylvania who worked as a mechanic suffered from severe back pain and sciatica. The pain prevented him from performing his job as a fleet mechanic for US Foods. He applied for Long Term Disability benefits, but CIGNA denied his claim stating that the medical information did not show that he was physically limited.
Clearly unable to work in his condition, he found Fields Law. The attorneys at Fields Law began reviewing the entire file from CIGNA and the report from their doctor. When the review was completed, we updated medical records and obtained statements from our client’s orthopedist. With the updated records and reports, our attorneys then drafted a winning appeal, causing CIGNA to revise their decision and reinstated the client’s monthly benefits. Our client was so thankful to get his benefits back and relieved that he would no longer have to worry about supporting himself and his family.
