Severe Back Pain

An Ohio man was injured in a work accident that left him with severe back pain. The pain was so severe that it prevented him from performing his job as a driver, or any other job for that matter. He was initially approved for Long Term Disability benefits. Later, his insurer reviewed his file and alleged that they had identified occupations which he could perform and was therefore no longer entitled to disability benefits.

Despite the insurance company’s claims, there was no way he would be able to continue working. He reached out to the attorneys at Fields Law Firm for help. The attorneys at Fields Law obtained additional evidence and drafted a strong appeal which argued the decision by the insurance company was wrong. Upon review, the insurer again claimed that he could work. Once the appeal was denied, our attorneys immediately filed a federal lawsuit. After litigation, the case was eventually settled.

A registered nurse was forced out of work due to severe shoulder pain. At the time, she received 24 months of Long Term Disability benefits under the own occupation standard set out in her plan. During this time, she underwent a lengthy period of physical therapy and multiple surgeries to help remedy the pain she was experiencing without any success. Despite this, her insurance company terminated her benefits under the Any Occupation standard.

Hand Tremor

A customer service representative for a large credit card company enjoyed working with fellow employees and an outstanding work environment with wonderful management. Unfortunately, she developed a significant tremor in her hands, which made using a keyboard extraordinarily difficult. Her managers were very patient with her despite her inability to work a full shift utilizing a keyboard. Eventually her manager suggested she apply for disability benefits until she could resolve the nagging tremor in her hands.

She applied for and initially received Long Term Disability payments, but as the condition persisted and defied doctors’ explanation and ability to diagnose and treat the condition, her Long Term Disability was eventually denied. The disability carrier argued that the tremors were caused by a pre-existing condition and therefore should not have been covered under the policy in the first place.

After several weeks of haggling with the disability carrier’s representatives, she became too frustrated and hired Fields Law Firm to review her case.
