Short & Long Term Disability Cases We’ve Won for Our Clients Against New York Life
Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability appeal case wins against New York Life.
Gene – HR Director – Eastman, Georgia
Foot Amputation
Working in Human Resources, a man in Georgia suffered severe diabetic complications, and he needed to undergo a right foot amputation. He left work following the surgery and was paid Short Term Disability benefits. However, his insurance company denied his claim for Long Term Disability when the Short Term benefits ended. The Human Resources Director searched for help online and found Fields Law to assist him in appealing the wrongful denial.
Our attorneys gathered medical evidence supporting our client’s inability to perform his past work in a plant setting, which required him to walk the grounds and observe day-to-day operations. After review of the appeal, the insurer agreed our client was unable to perform his own occupation and paid all outstanding back benefits. Our client was eventually able to return to work in a sedentary capacity, and our attorneys assisted him in claiming ongoing partial disability benefits.
Rusmira – Dietary Clerk – Lawrenceville, Georgia
Complications from Back Surgery, Multiple Sclerosis
A dietary clerk from Georgia suffered from chronic back pain and loss of motor skills due to a back surgery and multiple sclerosis. She experienced constant pain and discomfort so severe that work became impossible. She was approved for Long Term Disability benefits through her insurance company at work and received benefits for about two years. Suddenly, New York Life said she would no longer receive monthly benefits because she no longer met their definition of disabled.
Worried about her income and still suffering from chronic conditions, she called Fields Law Firm for help. Our support staff walked her through every step of the process as they gathered all our client’s medical records. The Fields Law attorneys compiled the records and presented them with strong legal arguments to New York Life to appeal the denial of benefits. New York Life changed its decision, and our client received a lump-sum check for back-pay and now receives monthly benefits again.
Carl – Airline Operations Supervisor – Irving, Arizona
Osteochondritis Dissecans, Knee Pain, Complications from Knee Surgery
An airline operations supervisor began having serious knee pain after an unsuccessful meniscus surgery. Walking was very difficult, and doctors told him he may eventually need to have knee replacement surgery. His job required walking between 24 gates at the airport to supervise employees, so he was forced to take a lower paying job that did not strain his knee as much. He received Long Term Disability benefits from his insurer while they were evaluating his claim, but after a few months they stopped paying.
Disappointed in this decision to stop paying his benefits, and worried about his lost income, he called Fields Law for help. The attorneys at Fields Law studied documentation from New York Life and discovered they were not using an accurate description of our client’s job. Fields Law attorneys filed a strong appeal and kept our client informed every step of the way. Ultimately, our client was granted continued benefits and issued a lump-sum payment for back-pay.
