A lumber yard manager from Michigan was suffering with chronic neck pain after undergoing a multilevel neck fusion surgery. He was removed from work and his treating providers noted he could not return to the physical nature of his previous occupation. He applied for Long Term Disability benefits through his employer’s plan. Unfortunately, the insurer denied the claim based on its review. Greater Georgia Life stated he could continue to perform the material duties of his occupation.
He turned to Fields Law for help. Our team worked with our client to build an appeal fighting this denial. We wrote to our client’s doctors receiving extensive narrative reports specifically responding to the Greater Georgia Life’s grounds for denial. Additionally, we pointed out substantial errors in the review that failed to consider all the relevant evidence in the claim file. After receiving our appeal, Greater Georgia Life reversed its decision, paid our client his backpay, and commenced monthly Long Term Disability benefits.
Benjamin – First Sergeant – Covert, Michigan

Working several years as a security guard at a nuclear power plant, a man from Michigan eventually attained the rank of First Sergeant. After developing degenerative disc disease in the lumbar region of his spine, he left work and filed a claim for Long Term Disability benefits. He received benefits for just under a year, when his insurer asserted that his condition had improved enough to allow him to return to work. The news was shocking because, if anything, his condition had worsened and made his activities of daily living even more difficult.

We submitted the medical records and evaluation to the insurance company along with a memorandum outlining our client’s legal rights under the statute governing the policy. A Regional Sales Manager from Michigan developed a strange cognitive condition where he would suffer from chronic dizziness, instability and memory loss. Prudential denied his application for both Short Term Disabillity and Long Term Disability benefits.

They acquired updated medical records from his providers and wrote to all of his primary doctors, asking for letters of support. We then drafted an appeal of the denial decision, arguing that Prudential misconstrued and omitted much of our client’s medical documentation. They accepted the appeal and after several weeks of consideration overturned their prior decision, granting back benefits through the Own Occupation stage of disability.
