Short & Long Term Disability Cases We’ve Won for Our Clients Liberty Mutual
Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability appeal case wins against Liberty Mutual.
Kenneth – Line Haul Trucker – Hockingport, Ohio
Heart Failure, Spinal Stenosis
A line haul trucker based out of Ohio developed some debilitating conditions that limited his ability to perform any sort of sustained activity. He applied for Long Term Disability benefits with his insurer and received an initial favorable decision. He was paid benefits for a year under the Own Occupation definition. However, he was denied benefits when Liberty Mutual determined he was able to perform some clerical work in the national economy.
He hired Fields Law Firm to appeal the wrongful determination. Our attorneys gathered substantial evidence that our client was unable to perform even sedentary work on a full-time basis. Additionally, our attorneys recognized that our client had a very limited vocational background and hired a vocational consultant to review whether our client would be a competitive applicant for employment. The vocational expert’s report was submitted together with the medical documentation resulting in a quick favorable decision for our client.
James – Quality Manager – Uniontown, Ohio
Neuropathy, Meniscus Tear, Low Back Pain
A quality manager at a manufacturing company became disabled after undergoing a laminectomy to relieve pressure on a nerve in his spine. After the surgery, he suffered from severe nerve pain that inhibited his ability to sit, stand, and walk for even short periods of time. Initially, his insurer agreed that the man was completely disabled and paid benefits in accordance with the terms in the policy. After approximately three years, the insurance company decided to deny benefits, stating the man could return to work at several sedentary occupations. The man was baffled because he spent most of his days completely incapacitated due to pain.
He searched for an attorney and chose Fields Law to fight for his benefits. Our attorneys collected updated medical records and narrative reports from our client’s treating physicians outlining his inability to work. Then, an expert was hired to review our client’s vocational history and write a report discrediting his insurer’s claims. The appeal was submitted early, and the decision was revised shortly thereafter. Our client was able to continue focusing on pain management with his financial security re-established.
Iva – Customer Service Representative – Mount Vernon, Ohio
Blepharospasm
A Customer Service Representative became disabled when she developed a severe eye spasm caused by a rare underlying neurological condition. She stopped working because tasks on the computer were impossible to perform in a timely matter. Her Long Term Disability claim was approved and paid out for two years. However, Liberty Mutual later denied her benefits saying that, although the claimant was unable to work her own job, she would be able to return to work at some sedentary occupations.
Not sure where to turn, she hired Fields Law to appeal the decision. Our attorneys reached out to her treating doctors and got detailed reports outlining her conditions. Liberty Mutual overturned their decision resulting in a payment of back benefits and monthly payments began shortly thereafter. Our client was so impressed with the representation we provided that she hired us to monitor her claim against Liberty Mutual and pursue a lump-sum settlement.
