Short & Long Term Disability Cases We’ve Won for Our Clients Liberty Mutual
Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability appeal case wins against Liberty Mutual.
Norma – Customer Service Representative – Colonial Beach, Virginia
Lumbar Radiculopathy
A Customer Service Representative selling propane and propane accessories loved her work and was a valued employee prior to developing severe low back pain. She submitted a claim to her disability insurance company. They approved her claim and paid benefits for just 6 months before denying her. The insurance company hired a doctor to review her medical records and stated that she was able to return to work.
The Fields Law attorneys began assisting in appealing her claim. We submitted updated medical records, arguing our client’s low back MRIs showed end-stage degenerative disc disease. After review of the updated records and the arguments on appeal, the insurer issued all outstanding benefits and reinstated benefits for our client.
Donald – Safety Manager – Grundy, Virginia
Degenerative Joint Disease in his Knee, Compression Fracture with Fusion Surgery to his Thoracic Spine, Spondylolysis, Arthritis
A Safety Manager from Virginia suffered from degenerative joint disease in his knee, a compression fracture with fusion surgery to his thoracic spine, spondylolysis, and arthritis. He was unable to work because of his conditions and received two years of Long Term Disability benefits from his insurer. Unfortunately, one month before the definition of disabled changed under his policy, Liberty Mutual determined he would not meet the changed “any occupation” definition of disability and informed him that they were discontinuing his monthly benefits.
He quickly reached out to Fields Law Firm for help. Our attorneys developed a plan to build the evidence necessary to win his appeal. We secured narratives from several of his treating physicians. We documented that Liberty Mutual had failed to properly credit our client’s favorable Social Security Disability award determination. Additionally, we pointed out that many of the occupations a “vocational specialist” that Liberty Mutual relied upon to discontinue benefits, were actually outside of our client’s limitations and restrictions. After reviewing our appeal the denial decision was reversed, our client received back pay, and he started receiving monthly benefit payments again.
Angela – Pharmacist – Houston, Tennessee
Ehlers-Danlos Syndrome
A young woman from Tennessee suffered from numerous health problems, most notably Ehlers-Danlos syndrome. While she had been able to overcome many of the difficulties of her condition and had become very successful, eventually the disease took too much of a toll on her and she was no longer able to work. After resigning herself to the fact that she would never be able to work again, she submitted a claim for Long Term Disability benefits, but her insurance company denied the claim.
Afraid and not knowing what she was supposed to do, she found the attorneys at Fields Law Firm. Our attorneys reviewed all of the records Liberty Mutual had and began getting updated records to provide. Due to health care costs, our client was forced to move to Mexico. As a result of the move, many of her recent medical records were in Spanish. The Fields Law team went so far as to translate many of the records to submit to her insurer. We then drafted a winning appeal which highlighted the numerous faults in Liberty Mutual’s review of the claim. On appeal, Liberty Mutual reversed their decision and reinstated the payment of monthly benefits as well as the benefits which were already past due. Our client felt an incredible sense of relief knowing that she now had a source of income to support herself and her family.
