Chronic Back Pain
A registered nurse from California suffered from chronic and severe back pain. This condition prevented her from being able perform any work, as she could not stand or walk without being in agony. Her Long Term Disability insurer denied her claim asserting that the medical information on file showed that she was capable of performing her own occupation.
Unable to work and scared about what to do, she reached out to Fields Law and our attorney knew exactly what to do. After completing his review of the insurance company’s file, her attorney developed a winning strategy for her appeal. He updated medical records which showed the chronic pain the client was experiencing. With the updated records, he then drafted an appeal which laid out the argument that her back condition was so serious that there was no way she could work. He also argued against the reasoning from the insurance company for their denial, highlighting the inconsistencies and failures in their review. The insurance company reversed their decision and reinstated our client’s monthly benefits.

Vertigo
A mechanic from Arkansas began experiencing severe bouts of vertigo. After seeking treatment with numerous neurologists and audiologists, they were unable to pinpoint what was causing his condition but they were not able to control it. This left him unable to perform any work, as he would be completely incapacitated by his vertigo. His Long Term Disability insurer denied his claim, stating that a reviewing doctor concluded that he had the ability to perform the duties of his job.

Michael – Maintenance Mechanic – Altoona, Alabama
Menieres Disease, Benign Paroxysmal Positional Vertigo
A Maintenance Mechanic from Alabama unfortunately developed Meniere’s disease and Benign Paroxysmal Positional Vertigo later in life and was unable to continue working. He received Long Term Disability benefits through his employer’s insurer. However, when the definition of disability changed under his policy, his insurer discontinued his benefits.
Liberty Mutual had hired private investigators to conduct surveillance and hired doctors to review his medical records. Although the surveillance footage never showed him doing activities outside his restrictions, and the medical record reviewers confirmed his diagnoses, the insurer denied the claim stating it had determined he could return to full time work in one of a few different jobs.
He turned to Fields Law for help. Our attorneys developed a plan to fight Liberty Mutual’s denial of the claim. Our team reached out to our client’s treating doctors, asking pointed questions in response to the insurer’s position. We built the arguments necessary to show Liberty Mutual had failed to properly credit our client’s Social Security Disability award, and hadn’t considered the most recent medical documentation. After reviewing our appeal, Liberty Mutual reversed its decision, paid our client his back pay, and reinstated monthly benefit payments.
