Short & Long Term Disability Cases We’ve Won for Our Clients in Kansas
Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability appeal and lawsuit case wins in Kansas.
Timothy – Distribution Coordinator – Manhattan, Kansas
Chronic Back Pain, Depression
A Distribution Coordinator for Driscoll’s suffered from severe back pain and depression. His condition prevented him from performing his job, which required him to be on his feet for many hours per day. His insurer initially approved his claim for Long Term Disability benefits, but his claim was later denied. CIGNA asserted that they found he had no activity restrictions that were medically supported and that they had identified occupations he could perform.
Clearly unable to work and unable to fight the insurance company, he reached out to Fields Law. His attorney reviewed CIGNA’s file and developed a plan to fight the denial. He updated medical records and requested reports from our client’s treating doctors. With the updated records and reports, our team then drafted a winning appeal. CIGNA reversed their decision and reinstated our client’s monthly benefits and paid all the past-due benefits. The client was so thankful to get his benefits back and relieved that he would no longer have to worry about finding income to support his family.
Doug – Tile Setter – Shawnee, Kansas
Bilateral Shoulder Pain, Complications from Rotator Cuff Surgeries
A tile setter from Kansas underwent rotator cuff surgery in both shoulders and experienced severe complications. He had constant pain and struggled to lift his arms above his shoulders. He applied for and was approved Long Term Disability benefits through his employer’s insurance plan. But after only two years, Sun Life Financial stopped paying him because they said he could return to work.
Upset at the insurer and worried about his lost income, he called Fields Law for help. Our team obtained the claim file from Sun Life Financial and found that they had overlooked key records about our client’s surgical complications. The Fields Law attorneys drafted a strong appeal to Sun Life Financial based on the factual and legal errors and updated expert opinions. Sun Life Financial changed their mind and our client received a lump-sum payment for back-pay and ongoing monthly benefits.
Nathan – Associate of Product Support – Wichita, Kansas
Diabetic Neuropathy
A man from Kansas suffered from severe diabetic neuropathy. Despite working a sedentary occupation and being seated most of the time, he was unable to continue working due to the chronic pain from his neuropathy as well as the inability to use his hands. His Long Term Disability insurer denied his benefits claiming that he had the functional capacity to perform his own occupation.
He contacted the attorneys at Fields Law, who reviewed all of the records the insurance company had and requested updated records to provide to the insurer. Our attorneys also obtained a report from our client’s neurologist which highlighted that our client could not work. On appeal, the insurance company reversed their decision and reinstated the payment of monthly benefits. Our client felt an incredible sense of relief knowing that he had an income on which to support himself and his family.
