Short & Long Term Disability Cases We’ve Won for Our Clients in Iowa
Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability appeal and lawsuit case wins in Iowa.
Tom – Commercial Cleaner – Manning, Iowa
Right Total Hip Replacement, Revision Surgery
A commercial cleaner initially needed a total hip replacement surgery after years of struggling with chronic pain. He was unable to do the heavy lifting that his job required and was forced to stop working. He submitted his disability benefits claim and his insurer agreed he was disabled from his job and paid benefits. However, two years later, The Standard revaluated his claim to determine if he was disabled from Any Occupation in the national economy. They felt he could perform desk work and denied his benefits.
Fields Law Firm was retained to contest the denial for our client. The Fields Law attorneys consulted with our client’s doctor closely to create a report outlining his conditions and limitations. The report was submitted to The Standard as a part of the appeal. Ultimately, The Standard reversed its decision and all past due benefits were paid to our client and his benefits were reinstated.
Anne – Overdraft Report Specialist – Muscatine, Iowa
Multiple Sclerosis
An Overdraft Report Specialist from Iowa progressively developed difficulty with cognition, weakness and maintaining balance while walking and standing. Initially, she assumed the symptoms would dissipate and go way, but when they didn’t, she saw her doctor who, after a battery of tests, eventually diagnosed multiple sclerosis. As the symptoms worsened, she was left with no choice but to file a claim for Long Term Disability, but her application for benefits was denied.
Frightened at the prospect of having no income to pay her bills, she hired Fields Law. Our attorneys reached out to her medical providers for supporting medical records and reports documenting her multiple sclerosis and showed the condition was very debilitating. An appeal was presented to Unum, who reversed its decision, reinstating her much needed benefits.
Melanie – Nurse – Ankeny, Iowa
Incontinence
A nurse from Iowa suffered from incontinence as a result of cancer treatments. She suffered from accidents multiple times a day and this condition made it impossible for her to work in any capacity. Her Long Term Disability insurer accepted her claim and paid benefits. CIGNA later denied her claim stating that she should be expected to return to work soon.
She reached out to Fields Law and our attorneys began updating our client’s medical records to provide the full scope of her condition. Once the records were compiled, we drafted a winning appeal which led CIGNA to overturn their denial and reinstate her benefits. Our client felt a huge sense of relief that she would have a steady source of income to support herself again.
