Here are just a few examples of our Long Term Disability appeal and lawsuit case wins in Illinois.
Brande – Field Tech – Lansing, Illinois
Systemic Lupus Erythematosus, End Stage Renal Failure
A young woman from Illinois suffered from Lupus and also suffered from renal failure. As a result, she was unable to perform her job as a Field Tech for a communications company. Her Long Term Disability insurer initially accepted her claim and paid benefits for nearly five years. New York Life later denied her benefits claiming that her disability was not clinically supported.
Clearly unable to work and unsure of what to do, she reached out to Fields Law. Her attorneys at Fields Law began reviewing the entire file from New York Life. After completing this review, we updated medical records and obtained statements from multiple doctors that our client had treated with. With the updated records and reports, our attorneys drafted an appeal which outlined how our client’s condition prevented her from working and that New York Life had failed to show that her condition had improved at all. New York Life reversed its decision and reinstated our client’s monthly benefits. Our client was relieved to hear that she would be getting her benefits back.
Leonard – Trucker – Chicago, Illinois
Stroke, COPD
A long-haul truck driver suffered from a stroke and COPD. Due to the effects of these conditions, he was unable to safely perform his job. His Long Term Disability insurer denied his claim on the basis that he had not provided evidence of his disability.
Not knowing what he was supposed to do, he found the attorneys at Fields Law Firm. The attorneys at Fields Law reviewed all of the records the insurance company had and began getting updated records to provide. They also obtained a report from his treating physician, which highlighted that our client could not work. On appeal, Guardian reversed their decision and reinstated the payment of monthly benefits. Our client felt an incredible sense of relief knowing that his livelihood was once again secure.
Michael – Security Guard – McHenry, Illinois
Panic Attacks, Depression, Obsessive Compulsive Disorder
A security guard from Illinois began feeling severely fatigued at work. He could no longer concentrate and had recurring panic attacks. A doctor diagnosed him with depression and obsessive compulsive disorder. His symptoms eventually became too severe and he was forced to stop working. He applied for Long Term Disability benefits and Liberty Mutual paid him monthly benefits. After receiving benefits for nine months, he received a letter saying that benefits would stop because he no longer fit the insurer’s definition of disabled.
Confused by the decision, he contacted Fields Law for help with an appeal. The attorneys at Fields Law reviewed the claim file and found that Liberty Mutual made several conclusions that were not supported by doctor’s opinions. Our attorneys contacted our client’s doctors to strengthen the case, and appealed the decision. Liberty Mutual agreed to reinstate Long Term Disability benefits for our client and pay him a lump-sum for back-pay.
