Dahlia – Nuclear Medical Technologist – Citrus Heights, California

Muscle Pain and Weakness

A Nuclear Medical Technologist from California suffered from extreme muscle weakness that could turn into a much more serious disease. She worked through it until her condition prevented her from doing almost anything. Three minutes on a seated stepping machine prevented her from walking for the two days following. She attempted physical therapy to try to fix her situation without any luck. She was taken out of work by her doctors and applied for Long Term Disability benefits through her employer, but her claim was denied. She could not understand how they did not see that she was disabled. She reached out to the Fields Law team for help through this complicated process.

The Fields Law team could not believe that the insurer denied this claim and immediately took on the case. Our attorneys submitted an appeal that pointed to all the ways in which our client was disabled, from medical records to the lack of being able to perform several activities of daily living. Our attorneys also obtained narrative reports from our client’s doctors to include in the appeal that supported disability. We also referenced that the Social Security Administration had deemed our client disabled and granted her Social Security Disability benefits. Metlife did not even conduct their own independent medical examination of our client before denying her benefits. Our client can no longer enjoy her life, let alone work, and the only people that could not see that was her Long Term Disability insurance provider. Following the appeal, Metlife finally accepted that our client was disabled and granted her ongoing Long Term Disability benefits. Our client was so grateful for the work of the entire Fields Law team.

Nadeem – Doctor – Stockton, California

Mitochondrial Myopathy, Nephropathy, Fatigue, Depression, Insomnia

A doctor from California began experiencing intense bouts of fatigue, depression, and insomnia after an extended trip out of the country to visit family. His symptoms did not improve, and he was diagnosed with Mitochondrial Myopathy and forced to stop working. He applied for Long Term Disability benefits through his insurance company at work, but was denied because Sun Life Financial said he was not working as a full time employee at the time of his disability.

Worried about his lost income and still unable to return to work, he called Fields Law for help. Our team obtained the full claim file from Sun Life Financial and our attorneys scoured the record for places where they made legal or factual errors. Our attorneys found that Sun Life Financial misinterpreted the policy as it applied to our client’s employment. The Fields Law attorneys drafted a strong appeal to Sun Life Financial based on strong legal research. Sun Life Financial changed their mind and overturned the decision, and our client received a lump-sum check for back pay and ongoing monthly benefits. Chronic Back Pain

A registered nurse from California suffered from chronic and severe back pain. This condition prevented her from being able perform any work, as she could not stand or walk without being in agony. Her Long Term Disability insurer denied her claim asserting that the medical information on file showed that she was capable of performing her own occupation.

Unable to work and scared about what to do, she reached out to Fields Law and our attorney knew exactly what to do. After completing his review of the insurance company’s file, her attorney developed a winning strategy for her appeal. He updated medical records which showed the chronic pain the client was experiencing. With the updated records, he then drafted an appeal which laid out the argument that her back condition was so serious that there was no way she could work. He also argued against the reasoning from the insurance company for their denial, highlighting the inconsistencies and failures in their review. The insurance company reversed their decision and reinstated our client’s monthly benefits.
