Short & Long Term Disability Lawsuit Cases We’ve Won for Our Clients
Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability litigation experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability lawsuit case wins.
Mark – Welder – Princeton, West Virginia
Chronic Inflammatory Demyelinating Polyneuropathy (CHIPS), Peripheral Neuropathy, Type I Diabetes
A welder from West Virginia developed permanent vision damage due to his job. He also developed a rare condition that caused him widespread and chronic pain called Chronic Inflammatory Demyelinating Polyneuropathy (CHIPS). Wracked by pain and essentially blind, he knew that his days of welding were over. He applied for Long Term Disability benefits from his policy’s carrier but was denied. He tried appealing the decision on his own, but the insurer upheld their prior decision.
He wanted to sue the insurance company, but would not do it without some expert help. He hired Fields Law and our team of attorneys filed a lawsuit in federal court within a month, and the insurer was forced to respond. Our attorneys provided arguments at the insurer, who immediately moved to begin settlement discussions and the Fields Law team secured a favorable settlement for our client.
Jennifer – Teacher – Milwaukee, Wisconsin
Mental Health, Lumbar Radiculopathy, Chronic Pain, Disc Degeneration, Fibromyalgia, Sacroiliitis, Hyper Insomnia
A Teacher from Wisconsin was approved for Long Term Disability benefits due to her disabling conditions. However, after two years her insurer discontinued benefits arguing that her disabling conditions were only mental, not physical. She was very confused because her records document various disabling physical conditions in addition to her mental health conditions. She reached out to Fields Law for answers and guidance and our team assured her that we would do everything we could for her.
The Fields Law attorneys started by gathering all her medical records and drafting an appeal that illustrated that our client had multiple physical disabilities and chronic pain that kept her from performing her occupation as a teacher. We also submitted reports from her physicians that supported her disability and explained the progressive nature of her pain condition. The insurer still continued with its denial. Our attorneys filed a lawsuit and got our client a very favorable lump-sum settlement. Our client was so grateful for the hard work of the Fields Law team.
Constance – Propane Sales and Customer Support – Elkhorn, Wisconsin
Carpal Tunnel Syndrome, Fibromyalgia, Rheumatoid Arthritis
A sales and customer support professional from Wisconsin underwent surgery for severe carpal tunnel syndrome. She suffered from arthritis and osteoporosis for years and hoped that surgery would help relieve symptoms in her arms. Unfortunately, surgery did not fix her symptoms and her intense pain forced her to miss work. She was initially approved for Long Term Disability coverage, but after receiving benefits for several months she was denied. She submitted an appeal, but the insurer did not change its mind.
Worried about her income, and running out of options, she contacted Fields Law for help. Our team obtained all the records from the insurer and our attorneys determined she had a good case for a lawsuit. We filed a lawsuit in federal court to fight for our client’s rights. During preparation for a hearing, our attorneys negotiated a generous lump sum settlement. Our client was happy to be done fighting the insurance company and continue treatment with her settlement money.
