Rachael – Production Technician – Gillette, Wyoming
Cervicalgia, Chronic Pain, Lumbar and Thoracic Spine Pain
A former Production Technician worked at a major mining facility until she suffered injuries to her neck and back. She was initially approved for benefits by her insurer. Unfortunately, after one year, her the insurer unexpectedly terminated her benefits. She reached out to the professionals at Fields Law Firm for assistance.
Our attorneys crafted a strong appeal by providing the insurer objective medical evidence, including MRI and X-ray results, of our client’s ongoing issues and treatment for her conditions. Her insurer upheld their denial of benefits because they believed the conditions our client was suffering from did not rise to the severity they believed necessary to prevent her from working.
In response, we filed a lawsuit against the insurer in pursuit of the client’s benefits. Due to the standard of review, it was determined that a settlement was in the client’s best interest. Ronald – Line Worker – Bluefield, West Virginia
Tachycardia, Hypertension, Neuropathy
A Line Worker for a telecommunications company in West Virginia was diagnosed with a host of medical conditions, including tachycardia, hypertension, and neuropathy which resulted in an inability to perform work in any competitive setting. Although the insurance company properly paid benefits for nearly 24 months, it denied benefits and claimed the man could perform the extremely heavy duties of his job as a line-worker despite his cardiovascular conditions and neuropathy. The insurer also gave no weight to the fact that the Social Security Administration found claimant completely and totally disabled.
He hired Fields Law to file his case in federal court. Our attorneys argued that even if our client wasn’t totally disabled, the most insignificant physical limitation from his conditions would rule out his ability to work as a line worker. After months of negotiations where we were able to increase the insurer’s top offer several times, and we successfully negotiated a settlement with the insurance company that allowed our client to supplement his Social Security Disability income and care for his two young children.
Amy – Radio Station Scheduler – East Bank, West Virginia

A Radio Station Scheduler from West Virginia began having severe hip pain after she had a right hip replacement a few months prior.
