Jimmy – Machine Operator – Smiths Station, Alabama
Cervical and Lumbar Degenerative Disc Disease, Chronic Opiate Usage, Neuropathy, Status Post-failed Foot Surgery
A Machine Operator from Alabama was forced out of work following a failed foot surgery and the worsening of his degenerative disc disease. He applied for Long Term Disability benefits but was denied by his insurer. Seeking help, he signed on with Fields Law Firm to fight his case.
The Fields Law Firm attorneys drafted an appeal of the insurer’s decision, including updated medical records and a letter of support from his primary treating physician. Unfortunately, the insurer upheld their denial of his benefits, so our attorneys filed a lawsuit against the insurer in federal court, arguing that their denial was not supported by the evidence. We were eventually able to negotiate a favorable settlement for all of our client’s claims and he received the check for the lump sum settlement just a few weeks later.

Robert – Dragline Operator – New Castle, Wyoming
Chronic Lymphedema from Prostate Cancer Surgery, Swelling, Neuropathy, and Discomfort in Groin and Lower Extremities, Lumbar Disc Herniation, Cervical DDD
A Dragline Operator suffered from chronic lymphedema following prostate cancer treatments, which caused chronic pain in his lower extremities and back. He worked in coal mines when he applied for and received Long Term Disability benefits. After two years, his insurer stated he was capable of working in a sedentary position, despite his physician’s restrictions, and denied benefits. He was at a loss and reached out to the Fields Law team for help.
Our attorneys submitted an appeal for him, but the insurer looked for every loophole to deny his claim. We stuck with our client and filed a lawsuit on his behalf. Our attorneys explained all of the ways in which the insurer handled the appeal review incorrectly. We got our client a lump-sum settlement that accounted for the majority of the benefits he was owed on his entire claim.
