Ahmed – Custodian – Minneapolis, Minnesota

Degenerative Joint Disease, Arthritis, Tendonitis in the Shoulder

A custodian working at a public school was forced to stop working due to degenerative joint disease, arthritis, and tendonitis in his shoulder. The Long Term Disability insurer initially awarded disability benefits. However, after paying benefits for several months, the insurance company discontinued his benefits. The insurer alleged that the definition of disability had changed and that the man no longer met the definition of disability. The insurance company based its denial on the opinion of a vocational consultant.

The disabled worker came to Fields Law for help getting his benefits reinstated. We fought hard for him every step of the way. We filed a strong appeal directly to the insurance company, which demonstrated that the vocational consultant’s opinion was not supported by the claimant’s functional capacity. Our team also represented the former custodian in his claim for Social Security Disability benefits. After our client was found disabled by the Social Security Administration, we used the SSA decision to support our client’s claim for ongoing Long Term Disability benefits. Fibromyalgia

A machine operator worked for several years prior to developing fibromyalgia. She submitted a claim to her Long Term Disability insurance carrier. The carrier denied her claim from the outset, stating she did not have any restrictions and limitations. She found Fields Law Firm online to appeal the insurer’s decision. Our attorneys secured medical evidence in the form of a narrative report from the client’s treating rheumatologist and submitted the appeal.

However, the insurer denied the appeal after it referred our client to an independent medical examination. Unsurprisingly, the insurance company’s doctor stated our client was fit to return to work and did not have any restrictions or limitations. Our attorneys filed a lawsuit against the insurance carrier alleging a failure to properly consider the medical evidence in the file and improper reliance on the independent medical examination. After several rounds of negotiations with the insurance carrier’s representative, we settled our client’s case on very favorable terms.
