Sally – Lead Logistics Manager – Dunnegan, Missouri

Chronic Pain Syndrome, Fibromyalgia, Lumbago, Insomnia

A Lead Logistics Manager in transportation stopped working due to chronic pain syndrome, fibromyalgia lumbago and insomnia. The Long Term Disability insurance company terminated her benefits in an impersonal letter after the benefits had run for almost seven years. The insurer’s denial letter determined she was not eligible for benefits because it deemed her able perform fulltime sedentary level work. This determination came as a surprise because her conditions and symptoms had not changed.

Upset at her sudden loss of income, she called Fields Law Firm for help appealing the decision. Our attorneys immediately filed a lawsuit against the insurer in federal court to fight for our client. During preparation for trial, Fields Law attorneys were able to negotiate a generous lump-sum settlement for our client. She was happy with the resolution of her case and the settlement check.

Amos – Fleet Maintenance Manager – Southwest City, Missouri

Multiple Chemical Sensitivities

A Fleet Maintenance Manager for a food trucking company developed a rare chemical sensitivity disorder in which in the presence of chemical odors, he would become nauseous and begin getting severe headaches and nasal burning. Unable to continue working in a maintenance shop, he applied for disability benefits from his insurance carrier. The insurer approved his benefits and allowed them to run for about year before they served a termination notice.

He appealed their decision on his own, but the insurer maintained their denial. Out of administrative appeals, and not knowing what to do next, he retained Fields Law Firm to pursue his benefits. The Fields Law attorneys requested his file from the insurer and reviewed the thousands of existing pages in the administrative records. The Fields Law team identified several errors the insurer made in their decision and filed a lawsuit against them in federal court. After several months of procedural moves, the insurer was forced to the bargaining table where the Fields Law attorneys were able to negotiate a settlement on behalf of our client.

Elizabeth – Registered Nurse – Perry, Maine

Multiple Sclerosis

A Nurse from Maine began having diffuse body aches and cognitive issues. She was diagnosed with Multiple Sclerosis and was forced to stop working due to the unpredictable waves of symptoms. She was approved for Long Term Disability because she was unable to continue in her duties as a nurse. After two years though, the insurer re-reviewed her claim and said she could do seated work. They denied her claim even though MS is a chronic and degenerative disease.
